Why traders file ITR-3, not ITR-2
F&O trading is non-speculative business income and intraday equity is speculative business income, both under the Income Tax Act. ITR-2 has no schedule for business income, so it cannot be used once either activity is present, even alongside a salary or capital gains from equity delivery. ITR-3 carries Schedule BP for business profit and loss plus the salary and capital-gains schedules ITR-2 also has, which is why it is the form most active traders end up filing. When the audit report joins the checklist
A tax audit under section 44AB, or the loss-year trap under 44AB(e), pulls Form 3CB-3CD into your document list. That report comes from your Chartered Accountant and has to be filed before the ITR itself, on a separate, earlier deadline. Why do F&O and intraday traders file ITR-3, not ITR-2?
F&O trading and intraday equity are treated as business income under the Income Tax Act, non-speculative for F&O and speculative for intraday. ITR-2 only covers salary, house property and capital gains, it has no schedule for business income. ITR-3 includes Schedule BP for business profit and loss, so anyone with F&O or intraday activity has to file it, even if they also have salary or capital gains from equity delivery.
Do I need an audit report to file ITR-3?
Only if a tax audit applies to you. Use the audit checker to confirm your 44AB, 44AD or 44AB(e) loss-year-trap position first. If an audit applies, the Form 3CB-3CD report from your Chartered Accountant has to be filed before the ITR itself, and the ITR filing deadline extends to reflect that. If no audit applies, you file ITR-3 on the regular non-audit deadline with just your P&L and balance sheet figures.
What is the most common missing document when filing ITR-3?
A combined, correctly computed turnover figure across every broker. Many traders bring one brokerโs Tax P&L and miss that turnover for audit purposes is the ICAI absolute-sum method, not the number some broker reports show. Can I use this checklist if I only trade equity delivery, no F&O?
If you only hold equity for delivery with no F&O or intraday activity, capital gains usually go on ITR-2, not ITR-3. This checklist assumes at least some F&O or intraday business income.
